The www.janans.com website (“Website”) is operated by JANAN'S Company (“JANAN'S”, “us”, “we”, “our”), which continues its activities under the JANAN'S trademark, and is duly established and still operating under the laws of the Republic of Turkey.

The Website is offered to you for your personal use subject to these terms and conditions and all other rules published on the Website (including our Privacy Policy) (“Terms and Conditions”).

Within the scope of the Terms and Conditions, references are made to customers of JANAN'S Kozmetik Sanayi ve Ticaret Anonim Şirketi (“Customer” “you” or “your”).

If you want to use our Services, you must read our policies regarding the relevant Services and accept that they are binding on you. In this context, we recommend that you carefully review our policies regarding the purchase conditions and the Disclosure Statement and Cookie Notice.

These Terms of Use apply to all JANAN'S sites, including the www.janans.com website located at Kültür Mahallesi Suna Sokak Hareket Sitesi No: 2 Beşiktaş/İstanbul, and all sites and applications of JANAN'S, its affiliates and subsidiaries, including mobile phones and various media. (together referred to as the "Site"). The Site is operated by JANAN'S Kozmetik Sanayi ve Ticaret Anonim Şirketi (JANAN'S). BY USING THE SITE, YOU ARE DEEMED TO HAVE ACCEPTED THESE TERMS OF USE; IF YOU DO NOT AGREE, YOU SHOULD NOT USE THE SITE.

If you are under 18 years of age, you must have one of your parents or legal guardians read the Information Text and Cookie Notice before registering on our site to use this Website or any of our Services; you also declare and undertake that you have obtained the necessary permission from your parents or legal guardian to purchase the products offered for sale on the Website.

JANAN'S manages and operates the www.janans.com Site from its Istanbul location; other JANAN'S sites may be managed and operated from various locations outside of Istanbul. Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are intended for all persons or in all geographic areas. JANAN'S reserves the right, in its sole discretion, to limit the provision or quantity of any feature, product or service to any person or geographic area. Any offer for a feature, product or service made on the Site is void where the Site does not provide service. The Intellectual Property and all other materials displayed on our Website may be accessed, viewed, downloaded and printed/printed for personal and non-commercial use only as expressly permitted by JANAN'S and/or its third party licensors; however, in no event may: (i) any modification or alteration of the Intellectual Property be made, and (ii) the Intellectual Property be provided or made available to third parties for commercial purposes.

ACCESS TO THE WEBSITE

You acknowledge and agree that (i) it is not technically possible to provide the Website without errors and flaws at all times and that JANAN'S cannot be held responsible for any errors or defects that may occur; (ii) such errors or defects may temporarily disrupt access to the Website; and (iii) the operation of the Website may be adversely affected by conditions and events beyond JANAN'S's control, such as data transmission and telecommunication links between you and JANAN'S and between JANAN'S and other systems and networks.

Although JANAN'S has made every effort to provide accurate product colors and shapes, the actual colors and/or shapes you see on the screen may vary depending on the screen features of the device you are using and may not reflect the actual product color or shape exactly.

JANAN'S may make partial or total temporary or permanent changes to the Website at any time, and may suspend access to the Website for maintenance and/or development and/or changes to the Website. JANAN'S cannot be held responsible for such changes or service interruptions or suspensions.

The above disclaimer applies only to losses, liabilities or damages arising from any failure to perform, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction, unauthorized access, alteration or use, breach of contract, tort, negligence or other legal cause.

JANAN'S reserves the right to take the following actions at any time without notice:

You may not trace or attempt to trace the information of any other user or visitor to the Site or any other customer of JANAN'S, including any JANAN'S account that does not belong to you, to its source. You may not use the Site or any service or information provided on or through the Site to disclose personal information, including but not limited to personal information, other than your own information as directed by the Site.

You may not forge headers or identifiers in order to disguise the origin of any message or transmission you send to JANAN'S on or through the Site or any service offered through the Site. You may not pretend to be or represent someone else or impersonate any other person or entity.

You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use or to solicit any illegal activity or other activity that violates the rights of JANAN'S or others.

OPINIONS, COMMENTS AND OTHER MESSAGES

Reviews, comments and other posts, photos or videos (collectively, “User Content”) are considered User Content if submitted in accordance with these Terms of Use and our Comment Rules.

Under these Terms and Conditions, you should only share content that you are comfortable sharing with others. When sharing your content, you agree not to share any comments or other messages that contain software viruses, political campaigning, commercial solicitations, chain letters, mass mailings or any form of “spam,” including, but not limited to, racist slurs or comments, use of profanity or vulgar language, insulting remarks against other users, disrespect for another culture, or any other abusive or inappropriate comments.

Your Content may be reviewed by moderators before it is published and may take up to 48 hours to be published; however, JANAN'S does not undertake to review all of Your Content or Other Content and shall not be liable in any way for the same.

Other Content should not be construed as an endorsement, support, representation, commitment or guarantee by us as to its completeness, accuracy, error-free or reliability, or as an endorsement of any views posted on the Website. You understand that by using the Website, you may encounter Other Content that may contain offensive language, be harmful, false or inappropriate, or in some cases, may be mislabeled or misleading.

The sender of User Content is solely responsible for the User Content, and JANAN'S assumes no liability whatsoever with respect to any User Content submitted. The sender agrees to indemnify JANAN'S against all claims and liabilities arising out of User Content. You acknowledge that we do not monitor User Content, but we reserve the right to review and remove any User Content for any reason, including User Content that we believe, in our sole discretion, violates these rules, the Commenting Guidelines, or is otherwise harmful to us, other JANAN'S visitors, or any third party.

For any User Content you submit, you grant JANAN'S a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete, adapt, publish, translate, create derivative works based upon, sell and distribute such content, and to transmit such content throughout the world in any form, medium or technology without compensation to you. Therefore, do not send us any comments, confidential information or stories, product ideas, computer code or original artwork that you do not wish to license to us. You also grant JANAN'S the right to use the name provided with the User Content you submit.

You must provide your real email address to submit User Content. Any content you submit will be routed through the Internet, and you acknowledge that you will have no expectation of confidentiality regarding User Content. By submitting your email address with respect to your review and comment, you agree that JANAN'S and its third party service providers may use your email address to contact you regarding your review or for other administrative purposes, however, JANAN'S has no obligation to respond to any User Content.

ELIGIBILITY CRITERIA AND ACCOUNTS FOR SALE

The purchase of products via the Website is limited to parties legally authorized to draw up and conclude contracts over the Internet under the laws of the Republic of Türkiye.

In order to make purchases through the Website, you must provide your personal information, including your real name and surname, valid mobile phone number, valid e-mail address, payment information, valid billing address and other required information. You declare and undertake that the payment information you provide is valid, complete and accurate, and confirm that you are the person referred to in the billing information provided.

Certain features or services offered on or through the Site require you to open an account (create an email and password). You are solely responsible for maintaining the confidentiality of the information in your account, including your password, and for any activity that occurs under your account if you fail to maintain the security and confidentiality of such information. You agree to immediately notify JANAN'S of any unauthorized use of your account or password or any other breach of security. If you fail to maintain the confidentiality and security of your account information, you may be held liable for losses incurred by JANAN'S or any other user or visitor to the Site due to someone else using your JANAN'S ID, email, password or account.

By submitting your offer to purchase the product or products, you agree that you have expressly authorized JANAN'S to perform credit card checks and to forward your credit card information to relevant third parties or to obtain the necessary information from third parties, as deemed necessary by JANAN'S, in order to identify you, verify your credit card, obtain authorization for the credit card and/or authorize a specific purchase transaction. You agree that we may use the personal information provided by you in order to perform the necessary checks against the risk of fraud in appropriate cases and that such personal information may be reported to the competent judicial and law enforcement authorities and such personal information may be recorded by the relevant authorities.

COMPENSATION

You agree to indemnify and hold JANAN'S, its officers, directors, shareholders, employees, agents, subsidiaries and affiliates harmless from and against any and all claims, damages, liabilities, claims or expenses (including attorneys' fees) that may be brought against JANAN'S by any third party in connection with any fraudulent activity arising out of your use of the Site.

JANAN'S reserves the right, at its own expense, to assume exclusive control of any disputes that would otherwise be subject to indemnification by you under these terms and conditions, and such right and indemnity shall survive the termination of these Terms and Conditions and the term of use of the Website.

VIOLATION OF TERMS OF USE

You agree that JANAN'S may share information about you (including your identity) in connection with any investigation or complaint regarding your use of the Site, or if we determine that sharing information is necessary to identify, contact or bring legal action against anyone who may be causing injury to or interference with JANAN'S rights or property, or the rights or property of visitors or users of the Site, including JANAN'S customers. JANAN'S reserves the right to share any information it deems necessary to comply with any applicable law, regulation, legal process or governmental request. JANAN'S may also disclose your information, including for the purpose of exchanging information with other companies and institutions, if JANAN'S determines that such sharing is required or permitted by applicable law.

You acknowledge and agree that JANAN'S may preserve any messages or communications you send through the Site or through any services offered through the Site and may share such data if required to do so by law or in the good faith belief that such preservation or sharing is necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that such data violates the rights of others, or (4) protect the rights, property or safety of JANAN'S, its employees, users and visitors of the Site, and the public.

You acknowledge that JANAN'S may, in its sole discretion and without prior notice, terminate your access to the Site for any reason, including, but not limited to, (1) requests by law enforcement or other governmental authorities, (2) a request made by you, (3) termination or material modification of the Site or a service offered on or through the Site, or (4) unexpected technical issues or problems.

In the event that JANAN'S commences any legal action against you for a violation of these Terms of Use, JANAN'S shall be entitled to recover from you, and you agree to pay, reasonable attorneys' fees and costs of such action in addition to any other rights available to JANAN'S. You agree that JANAN'S shall not be liable to you or any third party for any termination of your access to the Site resulting from any violation of these Terms of Use.

OTHER PROVISIONS

If any provision of these Terms of Use is held invalid or unenforceable by a court or tribunal of competent jurisdiction, such provision will be limited or eliminated to the minimum extent possible and replaced with a valid provision that closely approximates the intent of these Terms of Use so that these Terms of Use will remain in effect. These Terms of Use represent the entire agreement between you and JANAN'S regarding the use of the Site and supersede all other prior oral or written agreements or prior understandings between you and JANAN'S regarding such use.

Unless otherwise provided in a purchase agreement between you and JANAN'S, JANAN'S will not accept any offer inconsistent with these Terms of Use, and all such offers are expressly rejected. JANAN'S failure to insist on strict performance of these Terms of Use shall not be construed as a waiver by JANAN'S of any provision or future enforcement of these Terms of Use, nor shall any course of conduct between JANAN'S and you or any other person be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be construed as conferring any right or remedy on any third party.

If any provision of these Terms and Conditions is determined to be legally invalid or unenforceable, the other provisions of these Terms and Conditions will not be affected and will continue in full force and effect.

These Terms and Conditions have been prepared in Turkish.

These Terms and Conditions are subject to the laws of the Republic of Turkey and the consumer arbitration committee in your place of residence or where the consumer transaction is made is authorized to resolve any disputes that may arise in relation to these Terms and Conditions up to the value declared by the Ministry of Trade each year, and the Consumer Courts are authorized for disputes above the said value.
